Mortgage question

I appreciate any help anyone can give me. I have 2 mortgages that are due on the first of every month with a grace period of 4 days, so it is late on the 5th of the month. I mailed out my payments this month on the 3rd, so the letter was postmarked the 3rd, 2 days before it would be considered late, HOWEVER, the mortgage company didn't credit the account until the 9th, 4 days after the grace period. They sent my new bill with late fees assessed because they said it was late, even though the letter was postmarked well before the end of the grace period. Of course I have refused to pay the late fees, and they are unwilling to budge. Is there some sort of consumer law that says the payment is not late as long as the letter was postmarked before the grace period ends? I have NEVER, EVER dealt with a company who assessed a late fee if they received a payment after it was due as long as the envelope it arrived in was postmarked before the grace period was up. Any help appreciated. I plan to fight these money grubbing idiots and I won't pay them 1 single penny of their scam late fees.
 
you'll have to look at your contract to see what their policy is on late assessments...it wont be on your credit, but they can assess a late fee...its not when its postmarked but when they receive it....how much was the late fee....if you dont pay it, they can attach it to the pay off amount...but they wont report it the credit agencies..
 
I agree, it is not the postmark that matters, it is when it is recieved

agreed but comma . i have seen instances where the payments are received on time but arent processed by the lender untill after the bill is late . ESPECIALLY when the billing is contracted out .
 
postmark does not matter....the date of the payment should be the day it is received by the lender even though it may take a couple of days to process.....

are u sure they cant turn the late free over to collections?
