OT legal question

ok so heres the deal.. i was driving home from the gym yesterday and a fully loaded 18 wheeler didnt see me and hit me. hit the drivers side at 65mph which slingshotting my 3300lb car into the guard rail.. it bounced off back into traffic i regained control and pulled over.. needless to say im shaken up and my car has about 5k worth of damage. I am not injured other then being stiff and bruised which is unreal considering i just got hit by a truck. the guy admits total fault..here is the problem

the companies insurance company called saying that the blue book on my car is 2500 bucks.. *its WAS a mint condition collectors edition 1990 rx7 with 65k miles on it before being smushed) i own the car free and clear also. they want to let me keep the car and just give me the money... i think this is bullshit since now i would have to get a new car since the money wouldnt cover the extensive damage on the car not to mention the fact that being hit by a truck is basically a nightmare and i now dont really want to drive.. i am also way too sore to sit at work 12 hours. Do you guys think i should basically tell them no way i need more then that? get a lawyer? or just take the 2500... i really think thats total bullshit since i really could have been killed and now im left with a destroyed car and major anxiety about driving..

i think i may go and get an estimate on the damage then call and tell them to put my ar back the way it was its x amount.. and i missed work which equals y amount and im scared to fuckin death to drive on the truck infested highway which is worth z amount.. i dont know i just think its very wrong that they would even offer such a bullshit amount considering how bad this was.

if you guys think i should call a lawyer.. what kind? personal injury? civil? i have no experience with shit like this

it wouldn't hurt to talk to a lawyer, insurance comps will always try to low ball off the get go.
 
yea but how does that work..wouldnt she end up spending more money on te lawyer or do they end up paying that to?
 
a good lawyer can get a good settlement that would cover the fees. what trucking company was this?

i feel whiplash coming on :tounge2:
 
DO NOT ACCEPT THE MONEY!!

Refuse it every time they call. I doesn't cost anything to talk to a local lawyer. $2500 can turn into $10,000 real fast with just one letter from a lawyer...this too happened to me so I'm speaking from experience.

Just remember that if you accept the cash you can NOT go back and ask for more!!! So tell them you have a lawyer and that he will be contacting them. Also remember that the most lawyers don't charge you a thing they just take a percent of what they get for you. That's my suggestion anyway. :)
 
i called a lawyer that called the company he said he wants 10k and they are trying to authorize it. if he gets it i get the first 2500 then hes getting 20% of the rest which isnt that bad honestly.. they were very very upset i got a lawyer apparently lol

the trucking company is TMC and those douchebags are self insured
 
he quit today and called me telling me he had nightmares and started sweating when he got into his truck... hes all fucked up over this

so all of a sudden u feel bad for this guy

and they just hope your all like, o man i feel bad ill just take my 2500 and run, some one was affected by this just as much as me

Actually paying you cash and letting you keep the car isn't that bad, but since you were injured, you should be able to get much more.

I would suggest going to the doctor and getting a once over to make sure you're all good. Sometimes you don't know you've been injured until many weeks after your accident.

If you can prove he was wreckless then you'll stand to get even more money.

Glad to here you didn't get hurt.
 
well i think im just stiff and bruised not actually injured.. and i wouldnt say wreckless basically he was going the speed limit and there was another truck going up a little hill near me.. the guy was going slow because of the hill.. the guy that hit me was coming up too fast and had to change lanes at the last second so he didnt hit the other truck.. unfortunately.. he didnt see ME in the lane he chose to move to.. just sucked.. really bad day
 
can you post pics to check breast glands, vaginal infections, anal discomfort etc etc..we have some docs on the board..:iggthumpu
 
Saide, first off, glad you're ok (physically anyway). Second, take it from a car guy (i sell cars that is), $2500 for that car is good. Not saying I would take it in your situation, but gettintg anymore money for THAT part of the equation is a moot point. There going off black book value and no matter how nice that car is, it ain't worth shit in their eyes.

Just to be sure I did a manheim check (largest private auction in America), and the car has brought anywhere between $700-3500 depending on season, model, and area. Not many have sold in the NE.

Now, as for the insurance side of things, I would cease all comms with the insurance company. They hate lawyers and will do anything to skirt around them. Don't answer your phone if its them, and if you do, tell them they need to speak with your lawyer and you should let him/her know everytime they call. Stay on em and fight until you are happy. Whatever that may be.

thanks Rj :) ya physically im ok and now that i have figured out how to get to work and the gym without getting on the highway that should help mentally LOL the lawyer is doing all the rest apparently they were very upset about me getting a lawyer and when he said that in the long run we will bring this to court and it will cost them well more then what hes asking for they sounded like they kind of agreed with that. they are trying to get more authorized and he said i will know within the next few days. i just need to either fix that car or get something else... honestly ill prolly just gix the head lights use the rest to move and as a down payment on something else but still 2500 just isnt "right" to me considering the car was fine and its in no way my fault its totally fucked up now. here is the actual point of impact... the mirror on that side is also gone and the passenger side is squished from the guard rail

Just let your lawyer handle it, and make sure he or she does not take more than they should(ive seen it happen with the fine print)....You will end up getting more than 2500 by letting the lawyer do his or her job, so just ride it out...good luck
 
That really sucks! Go to the doctor and have your back checked out. You are bound to have old injuries they can pin on this accident. If you have a good lawyer you should be able to get quite a bit of money. Trust me if you were at fault your insurance company would be paying out the ass. Don't feel bad for the driver...he could have killed you. There is no room for mistakes when you are driving something that big. Maybe he was meant to do some other kind of work...this accident could have done him a favor.

thanks hun and i am going to the doctor tomorrow. i woke up today and i couldnt straighten my neck or turn my head... had to take a hot shower to be able to move normally.
 
the doctor thinks my neck is fucked up and is concerned about something crunching in my lower back. he also felt a bone deformity in my shin and isnt sure if its a bone bruise or a break so i got lots of xrays today.... they then electrocuted me to "relax" me and told me to come back tomorrow to see whats up with the extra and for more electricity lol fuckin joy... i might need an mri cause he thinks at the very least something is out of place and putting pressure on my spinal cord.. i was happier not knowing
 
Now I want to be electrocuted! Was it really relaxing?...mmmm. :D
 
oh hell no not even alittle lol

well nothing is broken but.. instead of the bones in my neck tipping towards my chin.. they arch towards the back of my head.. the actual bones in my neck have rotated to the right and are putting pressure on my discs which is why i have wierd numbness.. need an MRI... my whole spine is out of alignment and my right hip is 5 inches higher then the left.. ya im screwed.. the doctor thinks 20 weeks of 3 times a week with the PT as well as traction will make it BETTER.. joy.. got a sorta adjustment yesterday ... the screaming made him rethink doing it right then lol ugh.. now my legs go numb sitting at work.. next torture session is monday....cant wait
 
why does no one hit me up in the legal corner.....personal injury and dont agree to shit until your lawyer says yes......your back and neck hurts huh........
