Wtf do I do? Can I still get my hardship n drive if I didn't blow?

Big Karckk?? Your thoughts

I have been told by numerous lawyers to not blow into a breathalyzer machine if i have been drinking.

read this

When you are being pulled over by law enforcement and you are intoxicated you should remember one thing, "you are intoxicated and you are in the wrong". So with that into consideration you shouldn't think that you are being pulled over for no reason. There are two simple rules to follow and even though you are in the wrong, doing these two things should help your case and give you the best chance for getting out of the DUI or at least make it better for you when you go to court.

The first one is to be honest. Honesty will go a lot further than lying to an officer of the law. Like I said before, the officer already knows that you have been drinking or under the influence so lying to the officer about it will just make them mad. Not only that, the officer's now will usually record your actions and lies on video and use this against you in court. Video does not lie and if you are caught in a lie then you have absolutely no defense.

I have worked in the dispatch in law enforcement and have talked to the officer's. More times than not, the arresting officer said that they were going to let someone come pick the person up but the person kept lying and the officer got tired of the lies so they went ahead and arrested them. So when the officer asked if you have been drinking or on illegal drugs your best answer is to tell them yes. The number one answer when asked if you have had something to drink is "I had one or two". Be honest with them. I wouldn't go as far as to tell them that you have had a case of beer or anything but be honest enough to let them know you have had a few earlier.

The second thing is to be cooperative with the officer. The more you are uncooperative with the officer, the quicker they will arrest you. The reason being is even if you have just had one or two and you are not polite and uncooperative then the officer will find some other reason to arrest you just because they can. There are so many small things you can be arrested on that even if they can't get you for DUI they will definitely find something. That is the one thing that makes an officer the maddest is when the person being pulled over is uncooperative.

Most officers's now days have a breathalyzer machine in their patrol cars. I know that people have the right to refuse to blow in them. But I will warn you that when you get arrested for refusing, and you will, that will have a bad repercussion when it comes up in court. This is where the old phrase of "Catch 22" comes into play. If you have been drinking and have to blow in the breathalyzer you will probably go to jail. If you refuse to blow then you will go to jail. So that comes down to this. Look at it this way. If you refuse to blow and go to court, the judge has to go off of facts. If you do blow in the breathalyzer then it is recorded and used as physical evidence against you. Just because you refuse to blow doesn't make you uncooperative as long as you are polite while refusing.

The best thing to do is not to drive while under the influence. But if you do decide to drive then remember to be honest and cooperative and you will come out better than if you were to lie and uncooperative.

he's just trying to find out whats best for him to do at this point. Id like to know as well in case i see myself in this situation one day..and c'mom dont jump on the kid,,we've all done it.

Yea wetback really, this isn't a DR phil session nor intervention, I know my repercussions n what I did I just want to know sice I didn't blow(which they say is best) if I can still get my hardship meaning driving to and from work or anything that benefits my livelyhood, such as grocery store, etc...some claim if you don't blow, u can't. Get it!!! I just bought a brand new fuki Beamer!

Your gonna be paying fines out the ass but they might give you a temporary liscense or some shit.. I use to drink and drive all the time till one of my friends got killed

I know all this petty shit already, fines, suspended, court, blah blah...I can give a fuk about that shit right now...

My question is, am I still eligable to get a Permit to drive to and from work?? Some tell me if u blow u are, and if u don't or not...but some tell me you are still eligable...I wanna know this cuz I obviously have bills to pay and I can't have a choufer everyday to take me...

rippedfreak: "how do I avoid this damn manslaughter charge? Is there anyway to get out of life in prison? do you think ill be someone's bitch? Help me out bros!!

I'd call a local lawyer to get the answer to that.
Sorry to hear the news.
Unfortunately, this topic has negatively influenced my life, even though I have never had a DUI.
Don't want to get into it.

the trouble is once you refuse you really fuck yourself - I don't give a shit what a lawyer says - they are paid to get you off not know the law - if your laws are close to ours here in WI a DUI even if you blow over the limit is workable - sure you are suspended but you can get work hours licenses and stuff like that and even work a deal on the outcome - bottom line they will work with you

for a refusal you are revoked - no special help or special treatment - bottom line you are screwed

and of course since you didnt test you dont even know for sure if you were over the legal limit or if you may have been close enough for leniancy from a judge

Ask BK if you want but I think he will pretty much agree with me

Bwaaaaaaaaaaa...fucking wigger...its obvious RF aint never been locked up,,,,u trippin on a fucking DUI?...LOL...quit drinking that queer juice...cran and vodka...LOL.....prepare to get your wallet raped and yeh they will pull your license for a while,im not in Florida...but they usually suspend your shit, and if u lucky and the judge is in a good mood...u may get a restricted license...meaning u can drive only for work...oh and u be doing some community service............Z

Thanks for your input D...as for taking the test, I was defenitely over..no questions...thing is, I'm familiar with a lot of cops being that I've been in fire and done corrections, my neighbor has been a well known cop for over 15 years, his neighbor next to me is SWAT, my dad is great friends with a shit load of Miami-dade...only issue is that a state trooper pulled me over, so its difficult to have them talk to this fukin dick head...spoke with a friend of mine who is in contact with many judges, so that's the route I'm going for now...

Waiting for my lawyer to call me this morning
